Here is what the government is proposing to fix the broken system, and what it means for your next move.
The Big Changes Coming To The Housing Market
The roadmap targets the biggest pain points in the property journey, shifting the market from a messy, paper-heavy ordeal to a streamlined, digital-first process.
- Mandatory Upfront ‘Sales Packs’: Right now, critical details about a property, such as local searches or structural issues, often do not surface until weeks into the conveyancing process. Under the new rules, sellers will eventually be required to provide a comprehensive ‘Sales Pack’, including searches and a property condition report, before the home is even listed.
- Binding Conditional Contracts: To stop the heartbreak of a buyer or seller pulling out at the 11th hour, the government plans to introduce binding conditional contracts. Once an offer is accepted and the conditions are met, walking away will carry a financial penalty. This gives both sides the security to pack their boxes without second-guessing.
- Digital Logbooks And e-Signatures: Say goodbye to printing, signing, scanning, and posting endless forms. The roadmap pushes the industry toward digital property logbooks, secure digital IDs, and qualified electronic signatures to drastically speed up the legal work.
- Cracking Down On Estate Agents And Freeholders: The government is introducing a mandatory Code of Practice and formal qualifications for estate agents to ensure higher professional standards. Additionally, there will be strict reforms to stop freeholders and managing agents from charging extortionate fees and causing massive delays when providing leasehold information.
When Will This Actually Happen?
Because these are massive shifts across a complex industry, the government is phasing them in to give property professionals time to adapt.
2026: Guidance And Voluntary Preparation
The focus is on laying the groundwork. The government is working with the industry to identify what goes into a ‘sales pack’ so sellers can provide them voluntarily right away. They are also publishing non-statutory guidance for property listings, releasing a non-statutory Code of Practice for estate agents, preparing the sector for the eventual shift to binding contracts, and improving access to local authority property data.
2027 To 2028: Consultation And Digital Rollout
The government will consult on the exact penalty fees for breaking binding contracts and work with the industry to roll out digital IDs and property logbooks. Consultations for mandatory agent qualifications will also begin.
End Of Parliament: Legislation Becomes Law
Laws will be introduced making it illegal to list a home without an upfront Sales Pack. Binding conditional contracts and digital logbooks will become a mandatory part of the home-buying process.
